Welcome to Promo Code Queue! These Terms of Service ("Terms") govern your access to and use of the services, websites, and applications offered by Promo Code Queue ("we," "us," or "our"). Please read these Terms carefully before using our Service.

By creating an account, or by accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Service.

1Description of Service

Promo Code Queue (the "Service") is a platform that enables users ("Users," "you") to manage, automate, and distribute promotional codes, coupons, or other unique digital assets ("Promo Codes"). The Service facilitates fair, first-come-first-served distribution and provides features for capturing email addresses from individuals who wish to be notified of future promotions ("Waitlist Feature").

2User Accounts

Eligibility

You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are of legal age.

Account Security

You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

Accurate Information

You agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Service's registration form.

3User Responsibilities and Content

You are solely responsible for all data, information, and Promo Codes that you upload, post, publish, or display ("upload") or email or otherwise use via the Service ("User Content").

Ownership and Legality of Promo Codes

You represent and warrant that you own or have the necessary rights and permissions to distribute the Promo Codes you upload to the Service. You agree that your use of the Service will not violate any agreements you have with third-party platforms (e.g., Apple App Store, Google Play Store, Stripe).

Compliance with Third-Party Terms

You represent and warrant that your distribution of Promo Codes via our Service complies with all applicable terms, conditions, and policies of the third-party platforms from which the codes originate (including, but not limited to, the Apple App Store, Google Play Store, and any other platform). You are solely responsible for ensuring that your promotional campaigns adhere to these third-party agreements. Promo Code Queue is not responsible for your compliance with any third-party terms.

Value of Promo Codes

You acknowledge and agree that any promotional codes you distribute through the Service are provided by you and not by Promo Code Queue. You agree that, for the purposes of your use of our Service, the codes themselves have no monetary or cash value.

Compliance with Laws

You agree to comply with all applicable laws regarding your use of the Service. This includes, but is not limited to, laws related to marketing, advertising, and data privacy (such as CAN-SPAM, GDPR, CCPA). You are solely responsible for ensuring that your use of the Waitlist Feature and any subsequent communication with collected email addresses complies with all applicable laws.

Acceptable Use

You agree not to use the Service to:

  • Upload or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Distribute spam or any other form of unsolicited communication.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems or networks connected to the Service.

4Fees and Payment

Certain features of the Service may be provided for a fee. You agree to pay all applicable fees for the subscription plan you select.

Billing

We may use a third-party payment processor to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to these Terms.

Order Processing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscriptions

Service subscriptions will automatically renew for successive periods unless you cancel your subscription before the end of the current subscription period.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of the current billing cycle. No refunds will be issued for partial subscription periods.

5Refund Policy

You can create a Promo Code Queue account free of charge, but to start getting the Service you will need to subscribe to Promo Code Queue on a service period basis. After signing up for the Promo Code Queue Service, you may choose a payment method.

The paid Promo Code Queue Service renews automatically at the end of each service period and your chosen payment method is charged again, unless you decide to cancel your automatic payments before the automatic renewal. If you prefer to cancel the automatic renewal, you can do so in your profile at the section Subscription & plan or you can contact customer support via email at support@promocodequeue.com. Please note that by entering your payment details you agree to the automatic renewal. Promo Code Queue may change the price for the subscriptions, including recurring subscription fees, or other subscription terms from time to time and will communicate the new price or other changes to you in advance. Subject to applicable law, you accept the new price and terms by continuing to use the Service after the changes take effect.

We encourage you to use our live demo and free trial to evaluate the service before purchasing a subscription. If you choose not to use the Promo Code Queue Service anymore, we guarantee you a right to claim a refund within 30 days following your purchase of the Promo Code Queue Service. Please be aware that, according to these Terms of Service, you are allowed to request one (1) refund under the 30-day money-back guarantee. We will identify you by the information provided in your Authorization Form and the payment details used for purchasing the Promo Code Queue Service. Therefore, this means that you are entitled to a refund once, regardless of whether you decide to use the Promo Code Queue Service again. However, we would like to solve your issue before you decide to cancel the subscription, therefore you are always welcome to reach out to us at support@promocodequeue.com.

As a rule, you have no right to claim a refund after the period of 30 days from the purchase has passed. Nevertheless, in exceptional cases, we will consider refunds beyond this 30-day period, at our sole discretion, if you can demonstrate that the Promo Code Queue Service which you purchased was not available or usable and that you made reasonable attempts to contact us regarding this issue. In such cases, we may provide you with a pro-rata refund of Promo Code Queue Service fees paid during the subscription period when the Service was not available or usable.

We are not able to grant you a refund if you obtained the Promo Code Queue Service subscription via resellers other than Paddle. In scenarios in which your subscription was purchased through a reseller other than Paddle, it is necessary for you to consult with the original seller to understand their specific refund procedures and potentially obtain your refund through them. Please check with the individual reseller's terms for more information. However, if your purchase was made through Paddle, we can facilitate a refund for you in accordance with these Terms of Service.

You have a right to delete your account at any time, however, deleted accounts will not be refunded for the unused part of the ongoing Service period. No refunds will be considered for accounts terminated for violation of these Terms of Service.

6Complaint Resolution Policy

We are committed to providing excellent customer service and resolving any complaints promptly and fairly. If you have a complaint about our Service, please follow the procedure outlined below.

Step 1: Contact Our Support Team

First, please contact our customer support team at support@promocodequeue.com. Please provide:

  • Your account email address
  • A clear description of the issue
  • Any relevant order or transaction details
  • Steps you've already taken to resolve the issue

Expected Response Times

Initial Response: Within 24 hours (business days)

Simple Issues: Resolution within 3-5 business days

Complex Issues: Resolution within 10-15 business days

Technical Problems: Resolution within 5-7 business days

Escalation Process

If your complaint is not resolved to your satisfaction within the expected timeframe, you may escalate it to our management team. Please include "ESCALATION" in your email subject line and reference your previous support ticket.

Management Response: Within 48 hours (business days)

External Dispute Resolution

If we are unable to resolve your complaint to your satisfaction, you have the right to contact external dispute resolution services:

Better Business Bureau (BBB): You may file a complaint with the BBB at www.bbb.org

Consumer Financial Protection Bureau (CFPB): For financial service-related complaints, visit www.consumerfinance.gov

State Consumer Protection Offices: Contact your state's consumer protection office for local assistance.

Alternative Dispute Resolution

We are committed to resolving disputes amicably. If you prefer, we may suggest mediation or other alternative dispute resolution methods before pursuing formal legal action. Any such resolution will be conducted in accordance with the laws of the State of California.

7Intellectual Property Rights

Our IP

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Promo Code Queue and its licensors.

Your Content

You retain all ownership rights to your User Content. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating and providing the Service to you.

8Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, without limitation, a breach of the Terms.

If you wish to terminate your account, you may do so by following the instructions on the Service. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

IN NO EVENT SHALL Promo Code Queue OR Daniel Gauthier BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

10Indemnification

You agree to defend, indemnify, and hold harmless Promo Code Queue and Daniel Gauthier, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) User Content you upload to the Service.

11Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

12Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
